When you are hurt in a car crash, one of the first things on your mind will be how to get better quickly. Utah requires that your own auto insurance provider cover you for a minimum of the first $3,000 of medical bills regardless of fault. That can help a lot, but $3,000 does not stretch very far when you are paying for ambulance rides, emergency room visits, and X-rays. Once that $3,000 has run out, you will likely turn to your health insurance for help. A good health insurance plan will come in extremely handy at that point. Perhaps the clause is contractually invalid for some reason? Perhaps subrogating your claim would violate a federally guaranteed ERISA right?
